Terms of service.
The agreement between Noti5 and the businesses that use our notification infrastructure to send messages to their customers.

1. Who this applies to
These terms apply to any business, individual, or entity ("you", "Client") that creates an account on Noti5, integrates the Noti5 mu-plugin or API, or sends messages through the platform. By doing any of those, you accept these terms on behalf of yourself and the business you represent.
2. What Noti5 is
Noti5 is a transactional notification infrastructure platform. We route messages you authorise — email, WhatsApp, and one-time passwords — to your recipients via licensed providers (MailerSend for email, Meta WhatsApp Business Cloud API for WhatsApp). We are not a marketing platform, a CRM, or a mailing-list product. We do not send messages on our own initiative; every send is triggered by you or by a system you control.
Noti5 is operated from Chennai, India, in collaboration with The Bumblebee Branding Company Pvt Ltd.
3. Your account
- You must be a real business or have legitimate authority to send transactional messages from the brand you represent.
- You're responsible for keeping your API keys, dashboard credentials, and second-factor devices secure. Anything sent through your API key is treated as sent by you.
- You must provide accurate contact information and respond to operational messages from us (security, compliance, abuse) within a reasonable time.
- If you discover unauthorised use of your account or keys, notify abuse@noti5.app immediately.
4. Acceptable use
You agree not to use Noti5 to send any message that:
- Is unsolicited bulk or commercial messaging (spam) under any applicable jurisdiction's rules — including India's TRAI regulations, the EU GDPR/PECR, the US CAN-SPAM Act, and Meta's WhatsApp Business Messaging Policy.
- Targets recipients who have not provided clear consent to receive that type of message from the brand on whose behalf you're sending.
- Impersonates another person, brand, or organisation; misrepresents the origin of the message; or uses misleading subject lines or sender names.
- Contains malware, phishing links, illegal content, content that exploits minors, or content prohibited under Meta's WhatsApp policies or MailerSend's acceptable use policy.
- Is used for political campaigning, gambling, adult content, or any category that the underlying provider (Meta / MailerSend) does not permit.
- Attempts to harvest data, scrape recipients, or test deliverability against addresses you have no relationship with.
- Probes, attacks, reverse-engineers, or attempts to circumvent the rate limits, security controls, or sandboxing of Noti5 or its providers.
You're solely responsible for the content and recipient list of every message you trigger through Noti5.
5. Sender reputation — the shared resource
Noti5 sends from shared infrastructure. A small number of bad senders can damage the deliverability of every other Client on the platform. We treat sender reputation as a shared safety-critical resource:
- We monitor bounce rates, spam complaints, WhatsApp quality ratings, and provider-reported abuse signals continuously.
- If your account's metrics fall below acceptable thresholds — even if you believe you're acting in good faith — we may pause sending for your account, throttle volume, or require corrective action before resuming.
- In serious cases (confirmed spam, ToS violations, fraud) we will suspend the account immediately and notify you after the fact.
6. Suppression and unsubscribes
Noti5 maintains an account-level suppression list. Recipients who bounce hard, mark a message as spam, or unsubscribe are added automatically. You may not attempt to bypass the suppression list (e.g. by re-uploading suppressed addresses through a different channel). Suppressions are a compliance requirement, not a feature.
7. Data ownership and processing
Recipient personal data that you submit to Noti5 (email addresses, phone numbers, message variables, form-submission payloads, OTP requests) is processed by us as a data processor on your behalf. You remain the data fiduciary under India's DPDP Act 2023. The full handling, retention, and rights regime is described in our Privacy Policy.
Aggregate, non-identifying operational metrics (queue depth, error rates, provider latency) may be retained indefinitely and used to improve the service.
8. Fees and billing
Noti5 v1 is provided to a closed roster of clients of The Bumblebee Branding Company at no charge. We reserve the right to introduce pricing in future versions with at least thirty (30) days' notice. No charges are billed for v1 message volume.
9. Service availability
We aim to operate Noti5 with high availability but do not offer a formal Service Level Agreement (SLA) in v1. Delivery is best-effort and ultimately depends on the underlying providers (MailerSend, Meta WhatsApp Cloud API), recipient mail servers, and recipient mobile networks — over which Noti5 has no control. Scheduled maintenance and incidents will be communicated via the admin dashboard and / or email.
10. Suspension and termination
- You may stop using Noti5 at any time. To request account deletion, email hello@noti5.app. Personal data of your recipients is scrubbed per our Privacy Policy retention schedule.
- We may suspend or terminate your account, with or without notice, if we reasonably believe you've violated these terms, are damaging the platform's sender reputation, are being used as a vector for abuse, or if a provider (MailerSend or Meta) instructs us to.
- Sections that by their nature should survive termination (acceptable use, indemnity, limitation of liability, governing law) survive.
11. Disclaimers
Noti5 is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any specific message will be delivered to any specific recipient.
12. Limitation of liability
To the maximum extent permitted by law, Noti5's aggregate liability to you for any claim arising out of or relating to these terms or the service — whether in contract, tort, or otherwise — will not exceed the greater of (a) the fees you have paid to Noti5 in the twelve months preceding the event giving rise to the claim, or (b) Indian Rupees one thousand (INR 1,000). In no event will Noti5 be liable for indirect, incidental, consequential, special, or punitive damages, lost profits, lost goodwill, or loss of data, even if advised of the possibility.
13. Indemnity
You agree to indemnify and hold Noti5, its operators, employees, and partners harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from: (a) your use of the service; (b) the content of messages you triggered; (c) your violation of these terms or applicable law; or (d) any claim by a recipient of your messages.
14. Changes to these terms
We may update these terms from time to time. Material changes will be notified via the dashboard or email at least fourteen (14) days before they take effect. Continued use of Noti5 after the effective date constitutes acceptance. The "Last updated" date at the top of this page reflects the most recent revision.
15. Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts at Chennai, Tamil Nadu, India.
